Penalty: Apprentice Jockey Toni Davies is suspended for 4 National Riding Days

Evidence:

Following the running of Race 8, the “Entain – NZB Insurance Pearl Series Race”, Mr Goodwin presented an Information charging Ms Davies with careless riding in breach of Rule 638(1)(d).

It was alleged that Ms Davies allowed her mount “FREE RANGE” to shift inwards near the 1200 metre mark when not sufficiently clear of “LITTLEREDCORVETTE” (Ms C Butler), which was dictated onto the line of “BRIDAL TRAIN” (C Grylls), which was checked.

Ms Davies admitted the charge.

The race films, as interpreted by Mr Goodwin, illustrated that Ms Davies’ mount, was racing 4 wide shortly after the start of the 1400 metre race and Ms Davies was seeking to take up a position near the front and closer to the rail.  She allowed “FREE RANGE” to move inwards, when not sufficiently clear of “LITTLEREDCORVETTE”, which was initially slightly hanging out.  Ms Davies failed to correct her mount’s inward movement with the consequence of “LITTLEREDCORVETTE” being forced into the line of “BRIDAL TRAIN”, causing Mr Grylls to check his mount to avoid contact.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Goodwin submitted that the level of carelessness was low, but a suspension was required.  He advised that Ms Davies had had 192 rides over the past year with a good record (2 breaches in the past 6 months and none since August 2023).

Ms Hercock, on behalf of Ms Davies, submitted that the initial actions of “LITTLEREDCORVETTE” contributed to it being hampered and Ms Davies should be given some deferment of suspension because of upcoming engagements.

Reasons for Penalty:

From the Penalty Guide starting point of 4 National Riding Days, the Adjudicative Committee does not  consider any increase is warranted given Ms Davies’ good record and the minor level of carelessness.  The Penalty Guide refers to “National Riding Days”.

Conclusion:

A suspension of Ms Davies’ Licence to ride for 4 National Riding Days to commence at the conclusion of Racing on 9 March 2024, and to end at the conclusion of Racing on 16 March 2024, is imposed.
