Evidence

Following the running of Race 8, ‘The George Robinson Memorial Foxton Cup 2040’, an Information was lodged alleging the Respondent struck her mount KAHU ROCK 6 times prior to the 100 metre mark.

Rule 638(3)(g)(i) provides that in a flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in slapping motion down the shoulder with the whip hand remaining on the reins); or

Ms Davies confirmed to the Adjudicative Committee that she understood the charge and admitted the breach.

Using available film, Mr Goodwin illustrated, to the satisfaction of the Adjudicative Committee, that Ms Davies struck her mount on six occasions from the top of the straight to the 100 metre mark. It is noted KAHU ROCK went on to win the race.  Ms Davies agreed with the count.

Decision:

As Ms Davies admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Mr Goodwin presented the Respondent’s record. Ms Davies had received a warning for excessive whip use at the Otaki Maori Racing Club meeting on 10th March 2023. He referred to the current Thoroughbred Racing Penalty Guide effective February 2023. Ms Davies did not offer comment.

Reasons for Penalty:

The Penalty Guide indicates a starting point being a fine of $250 for 1 additional strike (6), 2nd offence, within the six months reference period. The Adjudicative Committee determined that KAHU ROCK winning the race was not sufficient to uplift, given that the horse was headed, and fought back, approximately 50-75 metres from the winning post. As such, a fine of $250 was considered the appropriate penalty.

Conclusion:

Apprentice Jockey Ms Toni Davies, is fined a sum of $250.
