Following the running of Race 2, the Stewards charged Mr Beeharry with a breach of r 638(1)(d) (careless riding) in that he allowed his mount OPHELIA ROSE to shift ground outwards checking an outside runner passing the 250 metres.

Miss Haley demonstrated on the videos that Mr Beeharry was racing near the rear of the field at the top of the straight when he commenced an outwards movement. In so doing, he pushed Mr Mudhoo (SELFIE) wider on the track and Mr May (TRIPLE HEART) who was racing outside Mr Mudhoo ran out of room and had to check his mount.

Mr Beeharry said he did not see Mr May coming and was not aware he was outside Mr Mudhoo. He had thought Mr Mudhoo was able to shift out.

Mr Davidson said Mr May, who had improved from behind Mr Beeharry, was entitled to his run.

Mr Beeharry has admitted the charge and it is found proved.

Mr Davidson said Mr Beeharry had just recently returned from overseas. He had no record of any breaches of the Rules. Mr Davidson described the breach as low to mid-range. Mr May was checked but his mount was not going that well at the time.

Mr Beeharry did not disagree with the Stewards’ assessment of the breach and stated he wanted any suspension to commence after racing at Timaru on 12 June. The Stewards did not object to this.

Mr Beeharry has shifted outwards when not clear of Mr Mudhoo. In so doing, he has dictated SELFIE outwards who in turn inconvenienced Mr May, the rider of TRIPLE HEART, the horse to Mr Mudhoo’s outside, who was crowded and had to check his mount.

The breach is mid to low range. The Committee takes a starting point of 6 days’ suspension to reflect this. This is the Respondent’s first breach of the careless riding Rule in the past 12 months. From a 6-day starting point, Mr Beeharry is afforded one day’s discount for record and his admission of the breach.

Mr Beeharry is suspended from the end of racing on 12 June up to and including 22 June 2022. This is 5 days.
