BACKGROUND:
Following the running of Race 6, Speight’s Summit Ultra On Tap Maiden, an information was filed by Stipendiary Steward, Mark Davidson, against the Respondent, Class A Jockey Rahul Beeharry, alleging that the Respondent struck his mount, LILITH, in 2 consecutive strides shortly after the start.
The Respondent had endorsed the Information “I do admit a breach of the rule” and he confirmed that he understood the Rule and the nature of the charge.
Rule 638(3)(g)(ii) provides that in a Flat Race a Rider must not “strike a horse with a whip in consecutive strides at any stage of the race”.
EVIDENCE:
Stipendiary Steward, Mark Davidson, showed a head-on video replay of the start of the 1400 metres race. He pointed out LILITH, ridden by the Respondent, which had drawn barrier position 10 in the 12-horse field. When the gates opened, the horse was very slow to begin, and shortly after the start, the Respondent struck the horse with his whip twice in consecutive strides in an attempt to get the horse to improve quickly, as it had lost so much ground, Mr Davidson said.
The Respondent said that the horse had been slow away in its recent races and he had given it a good warmup, in the hope that it would jump better in this race. It was slow away again and he had used his whip to teach it to, hopefully, jump better next time, he said.
DECISION:
The charge is admitted and is therefore deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Davidson said that the Respondent had received a warning for two consecutive strides on 25 November at Cromwell. The breach is therefore a second offence under the Rule. The Penalty Guide starting point is a fine of $150, he said. To his credit, Mr Beeharry complied with the Whip Rules for the remainder of the race, and only used his whip three times in the straight, Mr Davidson said.
REASONS FOR PENALTY:
The RIB Thoroughbred Racing Penalty Guide (February 2023) suggests a starting point of a fine of $150 for a second offence involving two consecutive strides. There are no relevant aggravating or mitigating factors.
CONCLUSION:
The Respondent, Rahul Beeharry, is fined the sum of $150.
