Mr Davidson alleged that Mr Muniandy struck his mount CAMINO ROCOSO with the whip six times prior to the 100 metres.
Evidence
Mr Davidson demonstrated on the video that when racing at the head of the field Mr Muniandy struck his horse six times prior to the 100 metres.
Mr Muniandy agreed with this count and said he just miscounted.
Decision
Mr Muniandy admitted the breach. It is thus found to be proved.
Submissions For Penalty
Mr Davidson produced Mr Muniandy’s record under the whip Rule. It is clear.
Stewards assessed the breach as low and submitted a penalty commensurate with the NZTR Revised Penalty Guide for excessive whip use.
Mr Muniandy did not disagree with this submission.
Decision as to Penalty
After considering the film evidence, the submissions and having due regard for the number (6) and frequency of strikes, the Adjudicative Committee determined there was no reason to depart from the starting point set out in the Penalty Guide for a first breach of the rule.
Penalty
On that basis the Respondent is fined $250.
