Background
Mr Davidson alleged that in Race 2 Mr Muniandy allowed his mount BACK HUT to shift inwards causing crowding to TAUMALOLO and BELASARD near the 1600 metres.
Mr Davidson demonstrated on the videos that shortly after the start and nearing the bend the Respondent shifted inwards from a 4-wide position and caused tightening to the horses to his inside. Mr Moseley had to check his mount and take hold. Mr Davidson played both the side on and head on videos which evidenced that Mr Muniandy was not his length and another clear.
Mr Muniandy said it had become a bit tight. He acknowledged he was 4-wide and had shifted in but also believed that FLOAT’s easing had contributed to the incident in that that horse had come back on TAUMALOLO and BELASARD.
Mr Oatham demonstrated on the video that the tightening as result of the Respondent shifting ground had occurred before this.
Decision
As Mr Muniandy has admitted the breach, it is found to be proved.
Submissions as to penalty
Mr Davidson produced the Respondent’s record which showed 3 breaches of the careless riding Rule in the previous 12 months. He was suspended for 6 days in February, 5 days in March and for 5 days in October. He said when regard was had to the fact Mr Muniandy had had 158 rides in the past 12 months and only one breach in the past nine months, he said that this was not a bad record. Mr Davidson described the breach as just below mid-range.
Mr Muniandy accepted Mr Davidson’s assessment of the gravity of the breach. He requested that any suspension start immediately.
Reason for Penalty
The breach is assessed as being at the lower end of mid-range. A Jockey shifting inwards not long after the start needs to ensure that the horses to his inside are given sufficient room. On this occasion Mr Muniandy was crossing close to the apex of the corner and crowded 3 horses to his inside which resulted in TIFFEN having to be restrained. Factoring in that the easing of FLOAT could be seen to be a contributing factor to the interference, a six-day starting point is appropriate. When regard is had to the fact that Mr Muniandy rides regularly, his record is neutral. A one-day discount is given for admission of the breach.
Conclusion
Mr Muniandy is suspended from the end of racing on 30 December 2022 up to and including 4 January 2023. This is 5 days.
