Penalty: Trainer Ashley Frye fined $300

Ms Frye admitted a beach of r 614(2) in that she omitted the lead bag when saddling DICELAND for Race 3.

Mr Davidson explained that when DICELAND was checked at the plate inspection, the lead bag was found to be missing from the horse. Ms Frye, who had saddled the horse, was not aware that a lead bag was required and it was found that the attendant had dropped the bag when taking the saddle to the tie ups. Ms Frye found the bag, and the horse, which finished second in the race, carried the correct weight.

The Penalty Guide provides a starting point for a first breach of this Rule of $300. Mr Davidson submitted that a penalty at this level was appropriate. He said higher penalties had been imposed but these were for repeated breaches.  Ms Frye apologised for the omission.

The starting point for a first breach is a fine of $300. There are no mitigating factors and the aggravating factor that the lead bag was not found to be missing until the Jockey weighed in was fortunately absent in this case.

The penalty is a fine of $300.
