Mr Davidson requested a Ruling under r 647(1) with respect to RED MOON RISING being placed 4th due to its Rider Mr Najib failing to weigh in as required following the race.
Prior to the commencement of the hearing the Respondent, Ms Frye, the Trainer of RED MOON RISING, said she understood the Rule and accepted it required the horse to be disqualified. She requested that she be able to leave to attend to the horse, as it was a very hot day and she wished to hose it down. As Mr Najib, the Apprentice Jockey who was the Rider of RED MOON RISING, was present, with Mr Moseley assisting him, she was informed that she could leave.
Mr Davidson stated that after the race, the Stewards were informed by the Clerk of the Scales, Ms Miles, that the Rider of the 4th placed horse, RED MOON RISING, had not weighed in. He went into the Jockeys’ Room and saw Mr Najib there adjusting his saddle, which was by that time on the floor.
Mr Najib stated that he forgot to weigh in. When questioned as to whether something had distracted him, he repeated he forgot and only became aware of the mistake when Mr Davidson spoke to him
Reason for Ruling
Rule 647(1) states:
All Riders in a Race shall weigh-in, unless excused from doing so by a Stipendiary Steward. A horse whose Rider does not weigh in shall, in addition to any other penalty which may be imposed, be disqualified from the Race, unless the Stipendiary Stewards are satisfied that the:
(a) Rider’s failure to weigh-in, in accordance with this Rule, was justified by extraordinary circumstances, including if the Stipendiary Stewards are satisfied that, on account of accident or sudden illness, it is impracticable for him to weigh in; and
(b) Rider weighed out correctly with, and carried, his proper weight.
This provision requires a Rider shall weigh in unless excused from doing so by a Stipendiary Steward. Mr Najib was not excused. The horse is to be disqualified (again the word used is shall) unless the failure to weigh-in is justified by extraordinary circumstances, including if the Stipendiary Stewards are satisfied that, on account of accident or sudden illness, it is impracticable for the Rider to weigh in. There was no accident or illness or any other extraordinary circumstance.
Ruling
The Stewards were advised that RED MOON RISING should be disqualified in accordance with r 647(1).
