EVIDENCE:

Following the running of Race 7, the THANKS TO THE PEOPLE THAT KEEP OUR STABLES GOING MOBILE PACE, Stipendiary Steward Mr Paul Williams presented an Information alleging a breach of Rule 869(2) by Junior Driver Mr Seth Hill.

Mr Hill stated he was conversant with the Rule, the Charge and he confirmed he admitted the breach. Mr Hill was supported by Open Driver Mr John Dunn.

Mr Williams played the race video to identify Mr Hill (PLAYING WITH STARS) racing in the lead position approaching the final bend. He pointed to Mr Hill use his whip continuously from the entrance of the home straight to the finish. Mr Williams said the strikes were merely flicks, but Stewards counted 30 strikes without any discernible pauses.

Mr Hill and Mr Dunn made no submissions.

DECISION:

The Respondent having admitted the breach, it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Williams stated Mr Hill had driven 81 times this season and was suspended for 2 days on 23 June under the same Rule, 13 drives ago.

Mr Williams said a suspension commensurate with the Guidelines would be appropriate.

Mr Hill and Mr Dunn made no submissions on Penalty other than to say any suspension could be taken immediately.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 3-day suspension for a second breach of this Rule. The Adjudicative Committee, after considering all factors, can see no reason to depart from the Guidelines on this occasion.

CONCLUSION:

Junior Driver Seth Hill is suspended for 3 days from the conclusion of racing today, up to and including racing on 16 August 2024.
