Penalty: Junior Driver Seth Hill is suspended for 4 days

EVIDENCE:

Following the running of the Race 7, Stipendiary Steward Miss Maja Szukiel-Deans, presented an Information alleging a breach of Rule 869(3)(b) by Junior Driver Mr Seth Hill.

Mr Hill stated he was conversant with the Rule, the Charge and confirmed he admitted the breach. Mr Hill was comfortable without the assistance of a Senior Driver.

Miss Szukiel-Deans played the video of the race and identified Mr Hill (THE ORANGE ROUGHY) racing in trail position following JUST LIKE JAGGER (K Green). She showed at approximately the 300m, Mr Hill shift into the passing lane and strike the near side wheel of Miss Green’s sulky, which deflated and came off the rim.

Mr Hill made no submissions.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Miss Szukiel-Deans stated Mr Hill has had 36 drives this season and this breach is his third. She said Stewards would recommend a 4-day suspension as an appropriate penalty.

Mr Hill made no submissions on Penalty but asked if he could defer penalty until after the Rangiora Meeting on Sunday 1st March.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 3-day suspension starting point for a second breach of the Rule.

The aggravating features of the breach are this is Mr Hill’s third breach and the trye deflated and came off the rim at a critical time of the race. The Adjudicative Committee considers these factors warrant an increase from the starting point of one day, to a 4-day suspension.

CONCLUSION:

Deferment is granted and Junior Driver Mr Seth Hill is suspended from the conclusion of racing on 1 March, up to and including racing on 11 March 2026.
