SUMMARY OF FACTS:

Following the running of Race 2 Chief RIB Steward Mr N Ydgren presented an Information alleging a breach of the Whip Regulations by Mr N Williamson which was admitted.

EVIDENCE:

Mr Ydgren played the home straight video and identified Mr Williamson driving SAND WAVE wide on the track. He pointed to Mr Williamson activate gear, turn his whip and strike his horse 2 times free of the rein before regaining a rein in both hands.

Mr Williamson said it is what it is, a mistake on his behalf.

REASON FOR DECISION:

Mr Williamson having admitted the breach it was deemed to be proved.

SUBMISSION FOR PENALTY:

Mr Ydgren stated Mr Williamson had a clear record under the Rule in the last 6 months. He said as this is a low-level breach a fine would be appropriate. He said the Guidelines provide for a $200 fine for this level of the Rule.

REASONS FOR PENALTY:

Mr Williamson’s clear record and professional approach to the charge cannot be considered in regard to Penalty as all whip indiscretions are mitigation inclusive. However, the level is low with the 2 strikes best described as flicks.

CONCLUSIONS:

Mr Williamson is fined $200.
