At the conclusion of Race 1 the Caduceus Club of Southland Trot, a protest was lodged by Stipendiary Steward Miss R Haley alleging that the second placed horse by the Judge, DONALD TRUMP, broke over the concluding stages being lapped onto MIXED FAITH (Miss K Tomlinson).
Mr Williamson the Trainer and Driver of DONALD TRUMP did not wish to be present at the hearing and did not contest the protest.

The Judge’s placings were:

1st –  4   OUR COUNTDOWN (B Williamson)

2nd – 1   DONALD TRUMP (N Williamson)

3rd –  6   MIXED FAITH (K Tomlinson)

4th –  7   JORDAN ANNE (M Williamson)

The official margin between second and third was a neck.

Rule 870(5) states:

Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Adjudicative Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its Driver, then (subject to r 869(8)) such relegation of the horse shall be at the discretion of the Adjudicative Committee.

Miss Haley demonstrated on the video DONALD TRUMP galloping from about 25 metres from the winning post being the equivalent of about three strides and being lapped on to MIXED FAITH.

It was clear from the video that DONALD TRUMP had galloped and was lapped on and had broken free of interference and accordingly DONALD TRUMP is in breach of Rule 870(5).

DONALD TRUMP is disqualified from second placing.

The protest is upheld, amended placings are:

1st –  4  OUR COUNTDOWN

2nd – 6  MIXED FAITH

3rd – 1   DONALD TRUMP

4th –  7  JORDAN ANNE

Stakes and dividends are to be paid accordingly.
