SUMMARY OF FACTS:

Following the running of Race 8 Mr Pinn was charged with using his whip 7 times, prior to the 100m when riding “BAZAMOUR” (5 is the limit).

EVIDENCE:

Mr Oatham showed the film replays which clearly showed Mr Pinn striking his mount twice on the bend and then a further 5 times in the straight prior to reaching the 100m.

Mr Pinn and Mr Harris who was assisting Mr Pinn agreed that it was 7 strikes in total.

REASON FOR DECISION:

As the charge was admitted along with the film evidence confirming that 7 strikes had been executed the charge was found proved.

SUBMISSION FOR PENALTY:

Mr Oatham said that Mr Pinn had a clear record and made reference to the Penalty Guide.

Mr Pinn said that he had never been warned or charged with a whip breach and was not a big user of the whip.

REASON FOR PENALTY:

Taking into account the record, Penalty Guide and Mr Pinn’s frankness, it was considered that a fine of $250 was appropriate.

CONCLUSIONS:

Mr Pinn was fined $250.
