SUMMARY OF FACTS:
Following the running of Race 3 an Information was lodged alleging Mr Kauri … used his whip excessively in the home straight.
At the outset of the hearing Mr Kauri confirmed that he understood the Rule and admitted the breach. Ms Clapperton confirmed this.
Film of the incident was presented. It was identified that Mr Kauri struck his mount on six occasions between the point of the turn of the home straight and the 100 metre mark. The Bliksem finished fourth in the event. When asked for comment Mr Kauri stated that it was simply a miscalculation on his part.
REASON FOR DECISION:
Mr Kauri admitted the breach, therefore the charge was deemed proved.
SUBMISSION FOR PENALTY:
Mr Goodwin presented Mr Kauri’s record. This is his third whip offence within the last six months with previous being:
Woodville 13/8/21 9 strikes prior to the 100m – $500
Otaki     31/7/21 8 strikes prior to the 100m – $300
Mr Kauri confirmed that he had riding engagements at Whanganui on 27th November 2021. In addition, at hearing date, Riders had been declared for the Cromwell meeting on 28th November 2021.
REASON FOR PENALTY:
The Committee had regard to the Penalty Guidelines. For a third offence the Guideline provides for a 5 day suspension plus 50% of Jockey share of stake (calculated to be $18.75).
The Committee determined that a 5 day suspension is an appropriate penalty. A fine was not imposed.
CONCLUSIONS:
Mr Kauri’s Licence is suspended for 5 NR days from the close of racing on the 28th November 2021 up to and including 8th December 2021.
