Outcome: Proved

Penalty: Class B Rider Liam Kauri is suspended for 5 days

Mr Davidson alleged that Mr Kauri rode carelessly in Race 5, in that he allowed his mount OCEAN BOULEVARD to shift inwards when not fully clear of BLUE GODDESS, which was placed in restricted room and clipped a heel, then blundering near the 900 metres.

Mr Munro demonstrated on the videos that on the bend exiting the back straight, Mr Kauri was following IT’S MARLIN, which was 2 ½ out but clear. In so doing, Mr Kauri has shifted in and put Ms Riddell (BLUE GODDESS) in restricted room. That horse clipped a heel and then blundered near the 900 metres.

Mr Laking stated Mr Kauri had gone in, and Ms Riddell was unable to relieve the pressure placed on her by Mr Kauri.

Mr Kauri said he had been wide for a lot of the race. He wanted to get in behind IT’S MARLIN. He accepted Mr Davidson’s description of the incident.

Decision

As Mr Kauri has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record, which evidenced 2 previous breaches in the past 12 months; one in May and the other in July. Mr Kauri has had 279 rides in that period.

Mr Davidson described the breach as just below mid-range. The consequences of the breach were high, but there was a lot happening in the race at that time.

Mr Laking said that Mr Kauri had a good record and was a safe Rider. It was a lack of judgement and riding experience on this track.

Mr Kauri confirmed his record and stated he wished the suspension to start after racing at Trentham on 20 December.

Reasons for Penalty

Mr Kauri has shifted ground inwards near the 250 metres, when not his length and another clear. BLUE GODDESS was crowded and checked. The breach is correctly categorised as a low to mid-range breach. From a 6-day starting point, there is a one-day reduction for admission of the breach and Mr Kauri’s good record.

Conclusion

Mr Kauri is suspended from the end of racing on 20 December, up to and including 28 December 2025. This is 5 National Riding days.
