Penalty: Apprentice Jockey Crystal Lindsay is suspended for 5 days

FACTS:

Apprentice Jockey C Lindsay, assisted by Riding Mentor K Clapperton, admitted a breach of Rule 638(1)(d)  in that she allowed her mount BINIKA to shift in near the 600 metre mark when not clear of DASH OF RED, which was checked.

EVIDENCE:

The films of the incident were shown and although the quality of the films were not good, they confirmed that Jockey C Lindsay’s actions in coming across to the rail, caused undue tightening to DASH OF RED, forcing Jockey J Chung to take hold.

Jockey C Lindsay confirmed that because of the strong wind blowing at the time, she did not hear anyone call.

Riding Mentor K Clapperton believed the windy conditions made it difficult for both horse and Rider.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Stipendiary Steward V Algar  classed the incident as mid range and stated that Jockey C Lindsay has had 108 rides so far in her career and has been suspended twice, these being 17/9/22 – a 5 day suspension and on 1/4/23 – a 6 day suspension was imposed.

She believed a period of suspension as per the Guideline was appropriate.

REASONS FOR PENALTY:

While accepting the windy conditions contributed to the incident to some degree, the incident could be clearly seen.  Jockey J Chung had to take hold of his mount and lost ground.

Jockey C Lindsay’s riding record in the short period of time she has been riding, her admittance of the breach, and the unpleasant riding conditions at the time, enabled her penalty for the mid range breach to be reduced by two days.

CONCLUSION:

Jockey C Lindsay was suspended from race riding for a period of five race days, these being after the completion of racing on 23/9/23 until the completion of racing on 30/9/23, a period of five days. A ten day deferment was asked for and agreed to.
