EVIDENCE:
Following the running of Race 3, Mr Goodwin presented an Information charging Mr Queiroz with a breach of Whip Rule 638(3)(f)(ii), in that he used his whip above shoulder height in the home straight on his mount (FIRST GEAR) on one occasion.
Mr Queiroz admitted the charge.
Race film evidence confirmed that his arm was raised above shoulder height on the one occasion.
DECISION:
As the charge was admitted, it was deemed proved.
SUBMISSIONS FOR PENALTY:
Ms Jillings produced Mr Queiroz’s riding record, which showed two previous whip-related breaches involving one strike with his arm above shoulder level:
• 24 August 2025 – fine of $250
• 30 August 2025 – fine of $300
Mr Queiroz was offered the opportunity to comment on penalty, but declined to do so.
REASONS FOR PENALTY:
This is Mr Queiroz’s third breach of Rule 638(3)(f)(ii) within a relatively short period. An uplift in penalty is therefore warranted, to mark the repeat nature of the offending and to reinforce the importance of adherence to the Whip Guidelines.
CONCLUSION:
He is fined $450 for this breach.
