EVIDENCE:

Following the running of Race 7, the “NEW WORLD ŌTAKI HANDICAP”, Mr Goodwin presented an Information charging Mr Queiroz, the Rider of DEALT WITH, with a breach of Rule 636(1)(d), in that he failed to ride his mount out to the end of the race, when able to do so, when there was a reasonable chance of it running into a position for which there was prize money to be awarded.

Mr Queiroz admitted the breach.

DEALT WITH finished 6th and the race films depicted that it had led into the home straight, but was weakening over the last 50 metres.  It was in 5th place, nearing the finish, when Mr Queiroz stopped riding and dropped his hands so that “HERBERT”, ridden by Ms T Davies, edged it out of 5th place, by a close margin, almost on the finish line.  But for Mr Queiroz’s actions, his mount would have held 5th place.

Mr Queiroz, in explanation, said he thought he was being “tightened” by the horse outside his mount, so “eased up”.  He agreed he erred in failing to keep riding.  The race films did not support a view that his mount was tightened.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Goodwin accepted that there had been an error of judgement on Mr Queiroz’s part, but no dividend bearing place was impeded.  However the difference in stakes earned, namely $500, required that a fine be imposed.

Mr Queiroz did not contest that view.

REASONS FOR PENALTY:

The Adjudicative Committee agreed that a fine was the appropriate sanction on this occasion.

CONCLUSION:

Accordingly, Mr Queiroz was fined $300.
