Background:

Following the running of Race 3, the ‘MYRACEHORSE 2100’ an Information was lodged alleging a breach of Rule 638(3)(f)(iii). The Information read as follows:

‘in that he used his whip on a runner when out of contention of finishing in the first five placings’.

Rule 638(3)(f)(iii) provides .. (f) a Rider must not use his or her whip (iii) when the Rider’s horse is out of contention of finishing in the first five placings;

Prior to commencement of the hearing, Mr Hashizume confirmed to the Adjudicative Committee that he admitted the breach and understood the Rule.

Evidence:

Using available film, Stewards identified the incident. In the home straight, REGAL WINGS was situated to the rear of the field. The Respondent is seen to strike his mount on three occasions prior to the 200 metre mark. Stewards were not concerned with this action. The horse did not improve as a result. The horse was again struck twice between the 200 metre mark and 100 metre mark and on a third occasion, closer to the post. Again, the Respondent’s mount did not respond. The horse finished 10th in a field of 11, 9.3 lengths from the winner and 5.5 lengths from the 5th placed horse.

When asked for comment, Mr Hashizume explained that he had ridden and won on the horse at Te Aroha on 11th November 2025, where it had responded to a strong ride. He admitted that in this instance, striking the horse, particularly on the last occasion, was unnecessary.

Decision:

As the charge was admitted, it was deemed proved.

Submissions as to Penalty:

Stewards advised the Respondent’s record. His record does remain clear, as it relates to any breach of this Rule within the last six months.  The Adjudicative Committee was referred to the current Penalty Guide.

Reasons for Penalty:

Film identifies the breach. The current Penalty Guide provides for starting point of a $300 fine for a breach of this Rule, 1st offence. On balance, the Adjudicative Committee found no compelling reason to deviate from the Guide. A fine of $300 was determined to be the appropriate penalty.

Conclusion:

Jockey Mr Masa Hashizume is fined a sum of $300.
