Penalty: Junior Driver Wilson House is fined $200

EVIDENCE:

Following the running of Race 7, Stipendiary Steward Mr Shane Renault presented an Information alleging a breach of Rule 858(1)(i) by Junior Driver Mr Wilson House.

Rule 858(1)(i) states a Driver must not:

(i) Fail to maintain his or her position.

Mr Renault stated a breach of this nature is usually handled by the MIN regime, but Race 7 was a Group Race and an Information had to be filed. Mr Renault said he had excused Mr House from attending the hearing because of the long delay of the last race and Mr House was very busy with his father’s team of 12 horses.

Mr Renault said Mr House had signed the Information and acknowledged he was conversant with the process and had no submissions to make on the evidence or penalty.

Mr Renault played the video of the start and identified VINCENT REACTRESS, Mr House, drawn 8 on the mobile gate and pointed to a length and a half gap between the horse’s nose and the gate when they had reached the start pole, which he said has breached the Rule.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Renault said Mr House had a clear record under the Rule and the usual fine is $100, however, because this was a Group 3 Race, the normal sanction is a $200 fine.

REASONS FOR PENALTY:

In keeping with the Guidelines, the Adjudicative Committee deemed a fine was an appropriate sanction on this occasion.

CONCLUSION:

Junior Driver Wilson House is fined $200.
