Background

Mr Davidson alleged that in Race 6 Mr Hong struck his mount LITIGATOR six times prior to the 100 metres.

Miss Haley prosecuted the matter in Mr Davidson’s absence. She asked Mr McIntyre to demonstrate the incident on the videos. He pointed out that the Respondent was making a run on the outside from near the rear of the field and struck his mount LITIGATOR 6 times prior to the 100 metres.

Mr Hong said he had a made a mistake.

Decision

As Mr Hong has admitted the breach, it is found to be proved.

Submissions as to penalty

Miss Haley produced the Respondent’s record which showed one breach in the previous six months, on 1 October when he was fined $500. Miss Haley submitted that a penalty in accordance with Guidelines was appropriate.

Mr Hong accepted this.

Reason for Penalty

The NZTR Guidelines provide for a fine of $250 where there is one additional strike, and the Jockey has a previous breach in the past six months.

Conclusion

Mr Hong is fined the sum of $250 and is reminded of his obligations under the Whip Rules.
