Penalty: Jockey BB Hong is fined $500

Background:

Mr Davidson alleged that in Race 4, Mr Hong struck his mount TREYBON 7 times prior to the 100 metres.

Ms Algar demonstrated on the videos that the Respondent was racing back of mid-field and struck his mount TREYBON 7 times prior to the 100 metres.  Mr Hong said he was counting and realised he had a made a mistake, but it was too late.

Decision:

As Mr Hong has admitted the breach, it is found to be proved.

Submissions as to Penalty:

Mr Davidson produced the Respondent’s record which showed one breach in the previous 6 months, on 3 June when he was suspended for 5 days. Mr Davidson submitted a penalty in accordance with Guidelines was appropriate. Mr Hong asked that it be as little as possible or that there be a suspension.

Reasons for Penalty:

The NZTR Guidelines provide for a fine of $500 where there are 2 additional strikes, and the Jockey has a previous breach in the past 6 months. We considered Mr Hong’s request that the penalty be a suspension, but he rides so infrequently it was difficult to determine what would be a meaningful penalty. When it became apparent that it might be multiple South Island meetings, the Respondent indicated a fine was perhaps preferable.

Conclusion:

Mr Hong is fined the sum of $500 and is reminded of his obligations under the Whip Rules.
