Mr Davidson alleged that Mr Hong struck his mount seven times prior to the 100 metre mark.

Mr Davidson demonstrated on the race films that Mr Hong was at the back of the field rounding the final bend. While in the run home Mr Davidson counted that there were seven strikes prior to the 100 metre-mark with the seventh strike just prior to the 100 metre mark.

Mr Hong agreed with this count.

As Mr Hong has admitted the breach, it is found proved.

Mr Davidson produced the Respondent’s record which showed two previous breaches of this Rule on 25 February 2022 where he received a $500 fine and 20 January 2022 where he was suspended for 6 days.

Mr Davidson submitted that a penalty in accordance with the Penalty Guidelines was appropriate. Mr Hong agreed with this.

The Penalty Guide provides that for a third breach with two additional strikes a five day suspension is appropriate.

Mr Hong is suspended for five days up to and including 9 June 2022.
