Background:

1. By Written Reserved Decision dated 13 August 2025, this Tribunal dismissed an appeal by the Appellant against the Decision of the Adjudicative Committee as to penalty, after the Appellant pleaded guilty to a charge under Rule 869(3)(b) of the Harness Racing New Zealand Rules.

2. In its Decision, the Appeals Tribunal reserved the question of costs, but invited both parties to make submissions.

3. The Appellant has made no submissions. The Respondent has indicated it does not seek any costs.

Discussion:

1. The Appellant was unsuccessful in her appeal. Although an Advanced Amateur Driver, her appeal has incurred costs to the industry in establishing this Tribunal.

2. The Tribunal considers it appropriate that the Appellant should make a modest contribution to the cost of this Tribunal.

Decision:

1. The Appellant shall contribute the sum of $500 towards the costs of this Tribunal.
