Mr Lowry admitted a breach of r 330(3)(c) in that he was unable to make the weight on CANDIDATE in Race 2.

Mr Davidson stated that the Respondent had advised the Stewards before the first race that he could not make the weight for one of his mounts today. He had one ride at 59.5kg but was unable to make 58.5 kg.

Mr Lowry said he had done his best to get to the weight and apologised to the connections of the horse. He said he did not think he could do justice to the horse if he took the ride.

Mr Davidson produced the Respondent’s record which evidenced this was Mr Lowry’s third weight breach within 120 days. He had been fined and suspended on one previous occasion when one race involved was a listed race, and had been fined on the other. He submitted a fine in excess of $200 was appropriate.

Mr Lowry said he had found it hard to lose weight after the suspension as he was out of his weight loss routine for a time. He had been flat out trying to get to 58.5kg. He believed a break from riding was necessary for him to be able to assess matters. He was intending to spend a few months at a stable in Australia and would be riding trackwork.

Mr Lowry has admitted the breach, so it is found proved.

This is Mr Lowry’s 3rd weight breach within 120 days. He notified the Stewards before the meeting and has forfeited only one ride. Connections have been let down. Fortunately, a like-for-like replacement was available. Mr Lowry’s apology is noted. A fine is appropriate on this occasion.

The Respondent is fined the sum of $250.
