BACKGROUND:
The Respondent Jockey, Jacob Lowry, admitted a breach of Rule 330(c) in that he failed to make the contracted weight for the horse, ATLANTIC CITY, in Race 5, Book a Suite for Autumn Racing Maiden.
Rule 330 provides:
(3)Â A Rider shall not:
(c)Â fail to ride a horse at the weight at which it is handicapped to carry.
EVIDENCE:
Stipendiary Steward, Mark Davidson, said that the Respondent had advised Stewards that he was unable to make the carded weight of 58.5 kg for his mount, ATLANTIC CITY, in Race 5. He was just “on the cusp”, Mr Davidson said. He was replaced on the horse (by Michael McNab).
The Respondent said he did not wish to make any excuses. He explained that he has four rides tomorrow (at Otaki-Maori RC) and needs to be “at his best” for those rides, so he did not wish to take off any more weight for this, his only ride today.
He said that a suspension would be more beneficial to him than a fine, as it would enable him to work on his weight problems.
DECISION:
The charge having been admitted, it is deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Davidson said that the Respondent has two previous breaches of the Rule – at Wingatui on 14 January 2023 (fined $100) and at Riccarton on 11 February 2023 (fined $200), both penalties being under the Minor Infringement Scheme.
The penalty can be either a fine or, if the Respondent preferred, a term of suspension, Mr Davidson said. Any fine should be in the vicinity of $250, he submitted. Any suspension, to be meaningful Mr Davidson said, would have to include at least one South Island riding day. He said that he would be making a recommendation to the National Racing Bureau that the Respondent not accept any rides under 59 kgs.
The Respondent said that a period of suspension would be more beneficial to him as it would enable him to work on his weight issues.
REASONS FOR PENALTY:
A fine for the breach would have been between $250-$300 so, in terms of a suspension, 4 national riding days (1 South Island riding day) is a sufficient penalty. Any more than 4 national riding days would incorporate another South Island day, which would make the penalty excessive.
CONCLUSION:
The Respondent’s application for a deferment is granted. His Class A Jockey’s Licence is suspended for 4 national riding days to commence after 4 March 2023, and conclude on 11 March 2023.
