Canterbury JC 23 April 2022 – R3 – Gosen Jogoo

BACKGROUND:

Following the running of Race 3, Double Tree by Hilton Karaka Rating 65, Class A Rider, Gosen Jogoo, admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d). The Information alleged that, as the Rider of SHANGHAI EXPRESS in the race, he angled his mount outwards crowding and checking PAZE THE POWER (Kin Kwo) passing the 125 metres.

The Respondent acknowledged that he understood the Rule and confirmed his admission of the breach.

Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

EVIDENCE;

Using the available video replays, Stipendiary Steward Mark Davidson demonstrated the incident and identified the horses and Riders concerned. He pointed out SHANGHAI EXPRESS, ridden by the Respondent badly held up for a run behind PAZE THE POWER, ridden by Kin Kwo. Mr Jogoo then angled for a run to the inside of PAZE THE POWER, which was “battling away”, and was checked. There was never a full run for Mr Jogoo, Mr Davidson said, and he pushed PAZE THE POWER across heels, forcing Mr Kwo to check his mount.

DECISION:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

SUBMISSIONS FOR PENALTY:

Chief Stipendiary Steward, Mr Oatham , said the breach was the Respondent’s fourth breach inside the last 12 months. Previous breaches were:

• 8 May 2021 at Riccarton – high-end, suspended 11 days and fined $300
• 16 October 2021 at Ashburton – mid-range, suspended 6 days
• 17 November 2021 at Invercargill – low-mid range, suspended 6 days.

Stewards saw this breach as being somewhere just below mid-range, Mr Oatham said. It was a mitigating factor that there had been a slight shift from the runner in front of him, DORIS DIOR (Corey Campbell) Mr Jogoo may have anticipated that a run was going to eventuate but there was never a full run for him. When he did attempt to improve, the runner in front did shift slightly.

The Respondent said that he had riding engagements at the Timaru meeting on 28 April and sought a deferment until after that meeting.

REASONS FOR PENALTY:

After a consideration of the video evidence and the submissions of the Stewards, the Adjudicative Committee assessed the breach as being in the mid-range. The starting point in terms of the NZTR Revised Penalty Guidelines (effective 1 March 2022) for a mid-range breach is a 7-days suspension. Mr Jogoo’s record is not a bad one. A discount of 1 day is appropriate for his admission of the breach.

CONCLUSION:

The Respondent’s request for a deferment is granted. His Class A Jockey’s Licence is suspended for a period of 6 national riding days commencing after racing on 28 April and concluding after racing on 6 May 2022.
