Evidence:

At the conclusion of Race 8, The Speights Handicap, Information A14154 was lodged by Chief Stipendiary Steward, Mr Oatham alleging Jockey, Mr G Jogoo permitted his mount (CHOUX IN) to shift ground passing the 75m crowding (FIERRY RED T Moseley and (PETE) L Callaway.

Mr Jogoo was present at the hearing and confirmed he understood the Rule and also that he admitted the breach.

The Rule reads: 638(1)(d) A rider shall not ride in a manner which is considered to be careless.

SUBMISSIONS:

Mr Oatham asked Stipendiary Steward, Miss Haley to demonstrate on the various video footage of CHOUX IN at about the 75m mark, shifting outwards and crowding FIERY RED (T Moseley) and then in turn PETE (L Callaway). Miss Haley highlighted the outward movement.

Mr Jogoo initially believed that some other horses may have contributed to the incident, however after viewing the footage he admitted that he had made an error of judgement.

REASON FOR DECISION:

As the Respondent Mr Jogoo admitted the breach the Committee finds the breach proved.

SUBMISSIONS FOR PENALTY:

Mr Oatham produced Mr Jogoo’s recent riding record which showed 2 previous breaches of the Rule over the past 12 months. On 8 May 2021 at Riccarton Mr Jogoo received a 11 national riding days suspension, range deemed to be high, and on 16 October 2021 at Ashburton he received a 6-day suspension, range deemed to be mid.

Mr Oatham believed that the level of carelessness in this instance was mid to low range.

Mr Jogoo did not request a deferment of penalty and offered no other submissions.

REASONS FOR PENALTY:

After considering the submissions the Committee determined the Respondent’s carelessness to be at the mid to lower end of the range and adopted a 7-day suspension as a starting point. This conforms with the NZTR Penalty Guideline as from the 1 September 2021.

 

Mr Jogoo has received a discount of 1 day for his admittance of the breach, and the breach on this occasion being at the mid to lower end of the scale.

CONCLUSION:

Mr Jogoo’s License to ride is suspended for a period of 6 national riding days commencing at the conclusion of racing of Wednesday, 17 November 2021 until the conclusion of racing on Wednesday, 1 December 2021.
