Evidence:

Mr Oatham, alleged that Mr G Jogoo (STOP YELLING), rode carelessly in Race 6 in that he permitted his mount to shift outwards, making contact and causing interference to BUDAI (Mr S Khetoo) near the 50 metres.

Miss Haley demonstrated on the videos that Mr Jogoo, shortly after the 100 metre mark, allowed his mount to veer outwards and make contact with BUDAI, which was making a run down the outside of the track. Mr Jogoo did not stop riding STOP YELLING until after there was contact. BUDAI was shifted sideways.

Mr Jogoo said he did not see BUDAI coming until the last minute. When questioned by the Adjudicative Committee, he said he was aware he was shifting out, but had not realised how much he had until he saw the video. He said he had corrected STOP YELLING but there had been contact.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Oatham produced the Respondent’s record which was clear under the Careless Riding Rule in the past 12 months. Mr Jogoo had 256 rides in that time. He described this record as excellent. The breach, he believed, was low to mid-range. The level of interference was not great, but there had been a relegation.

Mr Jogoo stated he would have rides at the next meeting at Wingatui and wished any suspension to start after 4 June.

Reasons for Penalty:

The breach is mid-range. While there was only a brushing between the horses, the contact was enough to shift BUDAI sideways and for the horse to lose momentum. Mr Jogoo was slow to correct STOP YELLING, which was veering outwards. A relegation resulted. A 7-day starting point is taken and, after credit for admission of the breach and excellent record, the penalty is a 5-day suspension.

Conclusion:

Mr Jogoo’s Licence to ride in races is suspended from the conclusion of racing on Sunday 4 June, until the conclusion of racing on Sunday 11 June 2023.
