Evidence:
Following the running of Race 3 the Respondent Dylan Turner admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d). The Information alleged that as the Rider of BOURBON FALLS:
” D Turner allowed his mount to shift inwards near the 1000 metres tightening VINO BIANCA (B Grylls) “.
The Respondent acknowledged he understood the Rule and confirmed his admission of the breach.
Rule 638(1)(d) provides: A rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.
Using the available films Senior Stipendiary Steward Mr Neil Goodwin outlined the incident and identified the horses and Riders concerned.
Approximately 100 metres after the start of the race ie: 1000 metres BOURBON FALLS was positioned three off the fence with VINO BIANCA and IFF I GET PAAID to his inside. At this point BOURBON FALLS is seen to shift in causing tightening to VINO BIANCA who lost approximately 3 lengths.
Mr Goodwin did comment that Ms Grylls was forced to take evasive action, however at the moment of the incident her mount was already laying in.
When asked for comment Mr Turner noted that his mount is a 2 year old having his first start. It was a very windy day and horses had been difficult to load causing his horse to become fractious.
Decision:
As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.
Submission for Penalty:
Stipendiary Stewards produced the Respondent’s riding record which is clear of charge over the last twelve months. They assessed the carelessness to be low range.
Mr Turner sought deferment to satisfy riding engagements at the Tauherenikau meeting on 27th March 2022.
Reasons for Penalty:
After considering submissions the Adjudicative Committee determined the Respondent’s carelessness to be low range. NZTR Guidelines provide for starting point of 5 days suspension in respect of low range.
Upon consideration, a 5 day starting point was adopted with a 1 day reduction applied to reflect admission of the the breach along with Respondent’s riding record.
Conclusion:
Mr Turner’s licence to ride is suspended for a period of 4 National Riding commencing at the conclusion of racing on the 27th March 2022 up to and including racing on the 6th April 2022.
