EVIDENCE:
Following the running of Race 2, the Respondent Mr D Turner admitted a charge alleging excessive whip use prior to the 100 metres.
Rule 638(3) provides that in a Flat race a Rider must not:
(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)
Using the available race films Stipendiary Steward Mr Goodwin demonstrated that the Respondent struck his mount 6 times from the straight entrance to the 100-metre mark. A 7th strike was established to be right at the 100m mark and was not counted. Mr Turner was satisfied this number was accurate.
REASON FOR DECISION:
As Mr Turner admitted the breach the charge was deemed proved
SUBMISSION FOR PENALTY:
Mr Goodwin produced Mr Turner’s record which showed no whip charges in the preceding 6 months. Mr Turner has only recently returned to riding after a break away, and Mr Goodwin said he rarely troubles the Stewards.
Stewards assessed the breach as low and submitted a penalty commensurate with the NZTR Revised Penalty Guide (1 September 2021).
REASON FOR PENALTY:
The Penalty Guide starting point for a breach of this nature is the greater of $250 fine or 50% of the Jockey share of stake. After considering the submissions and having due regard for the number and frequency of strikes, and the manner in which the whip was used the Adjudicative Committee determined there were no compelling reasons to depart from the starting point set out in the Penalty Guide. Mr Turner ran 3rd in the race with 50% of his share of the stake being less than $250.
CONCLUSIONS:
The Respondent is fined $250.
