EVIDENCE:
Following the running of Race 7, Stipendiary Steward Mrs Veronica Fisher presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Rider Mr Kavish Chowdhoory.
Rule 638(3)(g) provides that, in a Flat Race or Trial, a Rider must not:
- strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins).
Mr Chowdhoory stated he was conversant with the Rule and confirmed he admitted the breach.
Mrs Fisher identified Mr Chowdhoory (VOGUISH) on the final straight video, racing in the lead approaching the 300m. Mrs Fisher pointed to Mr Chowdhoory strike his horse seven times prior to the 100m and then another five times to the winning post.
Mr Chowdhoory made no submissions.
DECISION:
The Respondent having admitted the breach, it was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mrs Fisher stated Mr Chowdhoory has 2 previous breaches of the Rule on his record.
28 March 2026 at Manawatu, suspended for 5 days.
17 April 2026 at Egmont, suspended for 5 days.
Mrs Fisher said an uplift from the Guidelines was required for Mr Chowdhoory winning this race.
Mr Chowdhoory said he would like to defer any proposed suspension until after racing on 18 July 2026.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 5-day suspension for a third breach with 2 additional strikes.
The Adjudicative Committee finds an uplift of one day from the starting point, to be appropriate for this breach.
CONCLUSION:
Deferment is granted and accordingly, Class A Rider Mr Kavish Chowdhoory is suspended from the conclusion of racing on 18 July, up to and including racing on 26 July 2026 – 6 National Riding Days.
