EVIDENCE:
Following the running of Race 1, the “HAPPY HIRE SPRINT”, Mr Oatham presented an Information charging Mr Kavish Chowdhoory with a breach of Whip Rule 638(3)(g)(i) in that he struck his mount CASINO 8 times prior to the 100 metre mark.
Mr Kavish Chowdhoory admitted the charge.
The race films depicted that CASINO was racing wide on the track at the 400 metre mark, as the field was early in the home straight. Mr Chowdhoory struck his mount with the whip 8 times over the 300 metres prior to the 150 metre mark. The horse failed to adequately respond and finished 7th in the 9 horse field.
DECISION:
As the charge was admitted, it was deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Kavish Chowdhoory has had one previous breach of this Rule in the past 6 months, receiving a 5 days’ suspension on 18 October 2025. He made no submissions other than to say he made an error of judgement.
REASONS FOR PENALTY:
Because the breach involved 3 additional strikes (more than permitted) and there was a previous breach, a suspension of 5 National Riding Days was appropriate.
CONCLUSION:
Accordingly, Mr Kavish Chowdhoory’s Licence to ride was suspended for 5 days, to commence at the conclusion of racing on 6 April 2026 and to end at the conclusion of racing on 15 April 2026.
