Penalty: Driver Kerryn Tomlinson is fined $250

Mr Munro alleged that Miss K Tomlinson (HAZER) drove carelessly in Race 3 when striking the wheel of EDICT (Mr Hurrell) near the 500 metres, the tyre of which deflated.

Mr Munro demonstrated on the films that the inside leg of HAZER made contact with the off side sulky wheel of EDICT near the 450 metres. The tyre punctured. HAZER finished 8th in the race and EDICT 7th.

Miss Tomlinson said HAZER had been racing keenly at times. She had had quite a hold of the horse when she came out and had touched the wheel of EDICT. She had not realised that she had at the time and added she did not believe it had affected the result of the race.

Mr Munro confirmed that HAZER had been over-racing and was known to be a difficult horse to drive.

Decision

As Miss Tomlinson has admitted the breach, it is found to be proved.

Penalty Submissions

Mr Munro produced the Respondent’s record. Miss Tomlinson has had 36 drives this season and 204 last season. Her record is clear under this Rule, and he described her as a busy South Island Driver.

Mr Munro referred to the $300 starting point in the Penalty Guide with the consequences of the breach going to penalty.

Miss Tomlinson confirmed her record and agreed with Mr Munro’s submissions.

Reasons for Penalty

Miss Tomlinson’s actions have caused the tyre on the sulky wheel of Mr Hurrell’s horse to deflate. Mr Munro has agreed with Miss Tomlinson in that he said that EDICT was “battling away” and was not a winning chance when the breach occurred. The starting point in the Penalty Guide is a $300 fine. Mitigating factors are the admission of the breach and Miss Tomlinson’s excellent record, considering she is a busy Driver.

Conclusion

Miss Tomlinson is fined the sum of $250.
