Forbury Park TC 26 January 2022 – R2 – MIXED FAITH

SUMMARY OF FACTS:

Following the running of Race 2 Beach Road Holiday Park/Phillips Horse Transport Trot 2400m, an Information was lodged by Stipendiary Steward Miss Rebecca Haley instigating a protest into the 3rd place runner MIXED FAITH (Miss K Tomlinson) alleging a breach of Rule 870(3), namely that MIXED FAITH broke in excess of 50 metres over the final 200 metres.

Rule 870(3) provides:

That any horse which breaks in the last 200 metres of a race and continues in a break for distance of 50 metres or greater shall be in breach of Rule 870(3).

The Respondent Miss Kerryn Tomlinson elected not to be present at the hearing and indicated the protest was not contested.

The provisional placings are:

1st   Donald Trump (3) N Williamson

2nd  Streaming Live (7) S Ottley

3rd   Mixed Faith (6) K Tomlinson

4th   My Shout (2) M Williamson

The official margins were:
3 3/4 lengths, 1 1/2 lengths, head

SUBMISSIONS FOR DECISION:

Stipendiary Steward Mr Munro showed the various clips of the alleged incident highlighting MIXED FAITH in a break for at least 100 metres over the final 200 metres of the race. Miss Haley confirmed that MIXED FAITH had finished in 3rd placing and was not lapped on.

Miss Haley said the Stewards were seeking the disqualification of MIXED FAITH from 3rd placing.

REASONS FOR DECISION:

On reviewing the race films of the concluding stages of the race, it is very clear that MIXED FAITH broke and galloped free of interference for at least 100 metres over the final 200 metres of the race.

DECISION:

The protest is upheld and MIXED FAITH is disqualified from 3rd placing. The amended placings are:

1st   Donald Trump (3) N Williamson

2nd  Streaming Live (7) S Ottley

3rd   My Shout (2) M Williamson

4th   Cool Phelan (12) J Morrison

In accordance with this decision the payment of dividends is authorised.
