Evidence:

Following the running of Race 3, the Respondent Class A Rider Ms J Fawcett admitted a charge of careless riding, which was filed pursuant to Rule 638(1)(d). The Information alleged that as the Rider of SCOLERA, she permitted her mount to shift outwards when not sufficiently clear of LIECHTENSTEIN (W Pinn), which was contacted and forced wider, inconveniencing HIGH EMOTION (G Rooke) near the 450m.

Ms Fawcett acknowledged she understood the Rule and confirmed her admission of the breach.

Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Using the available race films, Senior Stipendiary Steward Mr Dooley demonstrated the incident and identified the horses and Riders concerned.

He said that rounding the final bend into the home straight, SCOLERA was on the rails, with LIECHTENSTEIN on its outer. Both horses were on level terms. Ms Fawcett angled her mount off the rails and contacted LIECHTENSTEIN, who was forced wider on the track and Rider Mr Pinn was unbalanced. HIGH EMOTION, who was trailing behind both horses, was inconvenienced for a stride.

Ms Fawcett in response, said that it was a mistake on her part and she it was unlucky that HIGH EMOTION was inconvenienced as “it happens in every race.”

Decision:

As Ms Fawcett admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Mr B Jones produced Ms Fawcett’s riding record, which indicated 5 previous breaches under the Careless Riding Rule in the last 12 months. This now being her sixth breach from 597 race rides. He said that Stewards assessed the breach to be in the low to mid-range.

Mr Jones also advised that Ms Fawcett’s record included a suspension she incurred for careless riding at the Waikato TR meeting on 30 January 2026 and as a result, a 6-day suspension was imposed, which will conclude after racing on 15 February 2026.

Ms Fawcett had nothing to add concerning penalty.

Reasons for Penalty:

After considering all submissions, the Adjudicative Committee determined Ms Fawcett’s carelessness to be in the low to mid-range and adopted a 6-day penalty as the starting point.

The available films established that Ms Fawcett shifted her mount out when she not the required distance clear of LIECHTENSTEIN. For at least 200 metres thereafter there was ongoing contact between SCOLERA and LIECHTENSTEIN. The consequences of which followed in a charge filed against Mr Pinn, the Rider of LIECHTENSTEIN. That charge was heard and dealt with separately.

This is now Ms Fawcett’s sixth breach of the Careless Riding Rule, from 597 race rides in the past 12 months. Whilst by any measure, six breaches in 12 months is not a good record and is unsatisfactory, it is tempered by the fact that it equates to one breach every 100 rides, which is not too far outside the norm. However, she cannot be afforded any credit for her record.

After consideration of the above factors, a 6-day suspension was imposed.

Conclusion:

Ms Fawcett’s License to ride in races is suspended from 16 February until 27 February 2026 (inclusive). This suspension follows her suspension that was incurred on 30 January 2026 at Waikato TR.
