EVIDENCE:
Stipendiary Steward Miss P Kinsey demonstrated the incident using the available race films. She showed where Mr Gillies used his whip once at the top of the straight and then 3 or 4 times in the run home. She said that Mr Gillies was using his arm rather than using a wrist flicking motion.
Mr Gillies agreed with Miss Kinsey’s statement but said that he thought that he was using the whip correctly. He said that it was hard to adjust from previous whip use habits.
REASON FOR DECISION:
The breach is admitted
SUBMISSION FOR PENALTY:
Miss Kinsey said that the breach was at the low end of the scale and she submitted that a fine of $200 was appropriate.
REASON FOR PENALTY:
The Committee agreed that the breach is low end and that a fine of $200 is appropriate.
CONCLUSION:
Mr Gillies is fined the sum of $200. The Committee also discussed with him the Animal Welfare reasons for the Whip Use Rules. He acknowledged those.
