Penalty: Driver Owen Gillies is suspended for 3 days
FACTS
Following Race 8, Mr Gillies the Driver of “OHOKA ACHILLES” admitted a breach of Rule 869(2) & the Whip & Rein Regulations. The breach being that he used his whip with more than a wrist flicking motion.
Mr Gillies said that he understood the Rule, charge and confirmed that he admitted the breach.
Film replays were shown with Mr Mulcay identifying where the whip was used in breach of the Rule.
Mr Gillies elected not to comment.
DECISION
As the charge was admitted, it was deemed proved.
PENALTY SUBMISSIONS
On 29 September 2022, Mr Gillies was suspended for 2-days for a similar breach.
The Stewards referred to the Penalty Guide.
Mr Gillies said that the Rules are the Rules.
REASONS FOR PENALTY
Taking into account the record and Penalty Guide, it was determined that a 3-day suspension was a suitable penalty.
CONCLUSION
Mr Gillies’ Driver’s Licence was suspended from the end of racing on 5 February through to all racing on 24 February 2023 (3-days).
