FACTS
Following Race 8, Mr Gillies admitted a breach of Rule 869(3)(b) Careless Driving.
The careless driving was near the 900m, when he allowed his horse to contact and puncture the outside sulky tyre of “BROOKIES JAFFA”.
Mr Gillies said that he understood the Rule, charge and confirmed that he admitted the breach.
Mr Mulcay played film replays and said that near the 900m, Mr Gillies shifted away from the fence and hit the wheel of “BROOKIES JAFFA”. He added that Mr Ferguson, the Driver of “BROOKIES JAFFA”, had said to the Stewards that his tyre was punctured near the 900m.
Mr Gillies did not dispute the fact that he had hit a wheel/tyre.
DECISION
As the charge was admitted, it was deemed proved.
PENALTY SUBMISSIONS
Mr Mulcay said that Mr Gillies had a clear record and said that the Penalty Guide starting point was $300.
Mr Gillies confirmed that it was his first charge of this nature.
REASONS FOR PENALTY
Taking into account that Mr Gillies had a clear record and admitted the breach, a fine of $250 was deemed appropriate.
CONCLUSION
Mr Owen Gillies was fined $250.
