SUMMARY OF FACTS:
Following the running of Race 6, the O’Connor Warren Insurance Brokers Open, and after the protest of Mr Cameron against the mount of Ms Rogerson (STAND TALL) had been dismissed, Mr Davidson presented an Information charging Ms Rogerson with a breach of Rule 638(1)(d) in that she carelessly rode her mount at about the 225 metre point.
SUBMISSIONS:
The evidence, already presented at the hearing of the protest, established that Ms Rogerson allowed her mount STAND TALL, to commence an outward movement passing the 225 metre point when challenging for the lead. The outward movement was prolonged and led to crowding, buffeting and checking of four horses (eventually place getters) HEZTHEWONFORUS, NEW YORK JAZZ, MARRONI, AND BRANDO.
REASON FOR DECISION:
As Ms Rogerson admitted the breach, it was deemed proved.
SUBMISSION FOR PENALTY:
Mr Davidson advised that Ms Rogerson was in her first year of riding as an Apprentice; had had 226 rides this season, and had incurred only one suspension in that time. He contended that the careless riding on this occasion was above midrange and a starting point of 8-9 National Riding Days was appropriate.
Mr Harris, on behalf of Ms Rogerson, observed that when first struck with the whip STAND TALL ran away from it and towards the 4 horses well outside and away from it, and Ms Rogerson’s lapse of judgment was in her not correcting the movement of her mount, but continuing to use the whip on the horse.
REASON FOR PENALTY:
As this was quite serious carelessness and hampering of 4 horses, a significant suspension is required but it is ameliorated by Ms Rogerson’s good record.
CONCLUSIONS:
Ms Rogerson is suspended from riding for 8 National Riding Days, to commence at the conclusion of racing on Tuesday 16 November 2021 and to end at the conclusion of racing on 28 November 2021.
