Penalty: Apprentice Jockey Bailey Rogerson is suspended for 5 National Riding Days

Evidence:

Following the running of Race 4 the Respondent admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d). Details are as follows:

“in that B Rogerson (Rua Rocks) allowed her mount to shift out when not sufficiently clear of Way Above (S O’Malley) and Run Like Boo (J Mudhoo) with both of these runners being buffeted and unbalanced and Way Above being checked and losing ground”.

The Respondent acknowledged she understood the Rule and confirmed her admission of the breach. This was confirmed by Mrs Allpress (Senior Rider assisting Ms Rogerson).

Rule 638(1)(d) provides:

“A Rider shall not ride in a manner which the Adjudicative Committee considers to be careless”

Using available film, Stipendiary Stewards demonstrated the incident and the horses involved. As the field straightened RUA ROCKS was sitting 1 horse width off the fence behind race leader QUEEN OF SPADES (Mrs Allpress) with WAY ABOVE and RUN LIKE BOO to her outside. At this point the Respondent is seen to move her horse out seeking to improve. As a result both horses to her outside suffered checks each losing 3-4 lengths. It was contended that the Respondent’s horse was not sufficiently clear of the outside horses.

When asked for comment the Respondent admitted an error of judgement.

Decision:

As the Respondent admitted the breach the Adjudicative Committee find the breach proved.

Submissions for Penalty:

Stipendiary Steward Algar outlined Ms Rogerson’s riding record which indicated 2 breaches within the last 12 months:

13/11/2021 8 days

2/10/2021 7 days

Stipendiary Stewards considered the level of carelessness to be just below mid range. The Respondent did not comment in respect of penalty although sought deferment of any proposed penalty to satisfy riding engagements at Cambridge on 31st August 2022. Mrs Allpress asked that some leniency in penalty be considered given a current lack of Riders.

Reasons for Penalty:

After considering all submissions the Adjudicative Committee determined the carelessness to sit between the low to mid range and adopted a 6 day suspension as the starting point. This is in line with the current NZTR Penalty Guide. The Adjudicative Committee is satisfied that the Respondent was insufficiently clear when shifting out thus causing Way Above and Run Like Boo to be checked. The starting point was reduced by 1 day to reflect admission of the charge along with the Respondent’s recent positive record.

Conclusion:

The Respondent’s request for deferment is granted, with her licence to ride in races suspended for 5 National Riding Days from the close of racing on 31st August 2022 to the close of racing on 9th September 2022.
