EVIDENCE:
Following the running of Race 3, Mr Goodwin presented an Information charging Mr Queiroz with a breach of Whip Rule 638(3)(f)(ii), in that he used his whip with his arm above shoulder height in the final straight.
Mr Queiroz admitted the charge.
Race film evidence confirmed that his arm was raised above shoulder height on one occasion.
DECISION:
As the charge was admitted, it was deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Goodwin advised that Mr Queiroz was fined $250 for a similar breach on August 24th, 2025.
Mr Queiroz explained that the NZ Rules are still new to him after riding in Singapore, and he is still learning.
REASONS FOR PENALTY:
Given this was Mr Queiroz’s second breach in a short period, a modest uplift from the starting point was considered appropriate. The action was not deemed extravagant and occurred for only one strike.
CONCLUSION:
He is fined $300 for this breach.
