EVIDENCE:
Following the running of Race 3, Ms Jillings presented an Information charging Mr Queiroz with a breach of Whip Rule 638(3)(f)(ii), in that he used his whip on his mount with his arm raised above shoulder height on one occasion in the home straight.
Mr Queiroz admitted the charge.
The evidence from the race films illustrated the horse “EXAGGERATION” surging to the front well into the home straight, being struck by Mr Queiroz using his whip once in the prohibited action. The horse was a very dominating favourite and proceeded to win comfortably.
DECISION:
As the charge was admitted, it was deemed proved.
SUBMISSIONS FOR PENALTY:
Ms Jillings advised that Mr Queiroz is a very busy Rider, with having been warned once for a Whip Rule breach. He has had 152 rides in the past 6 months and has a good record.
Mr Queiroz advised that he is trying hard to remedy what had been his permitted whip use when riding in Singapore, before coming to New Zealand.
REASONS FOR PENALTY:
Mr Queiroz’s riding percentage from winning the race on “EXAGGERATION” was $1,100.
CONCLUSION:
He is fined $250 for this breach.
