EVIDENCE:

Following the running of Race 9, the WINNING EDGE PRESENTATIONS 128TH WINTER CUP, Chief Stipendiary Steward Mr John Oatham presented an Information alleging a breach of Rule 638(1)(d) by Jockey Mr Bruno Queiroz.

Mr Queiroz stated he understood the Rule, the Charge and confirmed his admission of the breach.

Mr Oatham had Stipendiary Steward Mrs Veronica Fisher, show the final straight video to identify Mr Queiroz (BRADMAN) racing against the rail approaching the 150m. Mr Oatham said Mr Queiroz allowed his mount to shift outwards, crowding and checking OUR JUMALA passing the 125m.

Mr Queiroz made no submissions.

DECISION:

The Respondent having admitted the breach, the Charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Oatham said Mr Queiroz has only been riding in New Zealand for a short time, having his first ride in May. He said his record is clear and his admission is to his credit.

Mr Oatham said the breach was in the mid-range, given the amount of ground he allowed his mount to shift, while continuing to ride his horse out.

Mr Queiroz wished to defer any suspension until after racing here, on Wednesday 6 August.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 7-day suspension for a mid-range breach of the Rule, which the Adjudicative Committee agrees this is.

The status of this race, the Black Type Group 3 Winter Cup, demands an uplift of penalty, which is determined at 2 days. Mr Queiroz is given a discount of one day, for his clear record (136 rides in NZ) and his admission of the breach.

In addition to this 8-day suspension, a fine of $250 is imposed as per the NZTR Penalty Guidelines, when an offence occurs in a Black Type race.

CONCLUSION:

Deferment is granted and Mr Queiroz’s Licence to ride in races is suspended from the conclusion of racing on 6 August, up to and including racing on 17 August 2025. In addition to this suspension, Mr Queiroz is fined $250.
