Penalty: Apprentice Jockey Floor Moerman is fined $500

EVIDENCE:

Following the running of Race 8, Chief Stipendiary Steward Mr John Oatham presented an Information alleging a breach of Rule 638(3)(f)(iii) by Apprentice Rider Miss Floor Moerman.

Miss Moerman stated she understood the Rule, the Charge, and confirmed her admission of the breach. Miss Moerman was assisted at the hearing by Apprentice Mentor Mr Jason Laking.

Mr Oatham played the final straight video to identify Miss Moerman (REPROBATE) in the middle of the track and stated she had raced in a wide position throughout the race.

Mr Oatham pointed to REPROBATE giving ground at the 600m, quickly becoming a beaten runner. He then pointed to Miss Moerman strike her mount 7 times when out of contention and showing no sign of a positive response.

Miss Moerman chose to make no comment on the charge. Mr Laking said the incident was a severe lack of judgement.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Oatham said Miss Moerman was fined $300 on 10 June 2025 for a breach of this Rule and was warned previously.

Mr Oatham said a fine of not less than $500 would be appropriate for this breach.

REASONS FOR PENALTY:

The Penalty Guidelines provide a $500 starting point for a second breach of this Rule. Although consideration has been given to Miss Moerman’s admission and status as an Apprentice, the Adjudicative Committee is not departing from the Guidelines on this occasion.

CONCLUSION:

Apprentice Rider Miss Floor Moerman is fined $500.
