EVIDENCE:
Following the running of Race 7, Chief Stipendiary Steward Mr John Oatham presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Jockey Miss Samantha Wynne.
Miss Wynne stated she was conversant with the Rule and the Charge and confirmed she did admit the breach.
Mr Oatham identified Miss Wynne (SACRED DREAM) on the final straight video racing in the lead approaching the 400m. Mr Oatham pointed to Miss Wynne strike her horse 8 times prior to the 100m and said there were no strikes inside the final 100m.
Miss Wynne made no submissions, but said she was well aware she would be facing a stiff penalty. Miss Wynne was then excused from the hearing, as she had her team loading for their journey home.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Oatham stated Miss Wynne had breached this Rule twice on the same day at the Cup Meeting at Riccarton in November and contravened the Rule twice on the same day last week, 26 April 2025. He said this is now her fifth breach within the reset period and the Guidelines indicate a 5+ day suspension as Penalty.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 5+ day suspension starting point for a fifth breach of this Rule, with 3 additional strikes.
The Adjudicative Committee considers Miss Wynne’s poor record to be an aggravating factor.
Miss Wynne is due to start a combined 13 national day suspension following today’s racing for breaching the Whip Regulations.
The system must send a clear message that repeated disregard for the Rules won’t be tolerated.
The Adjudicative Committee is running out of patience for Miss Wynne to improve her whip use and finds an uplift from its previous imposed penalty of 7 days last week, to a 9-day suspension, to be appropriate in the circumstances of this breach.
CONCLUSION:
Class A Jockey Miss Samantha Wynne is suspended from the conclusion of racing on 25 May 2025, up to and including racing on 8 June 2025.
