EVIDENCE:
Following the running of Race 7, the listed WARSTEP STAKES, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Jockey Miss Samantha Wynne.
Miss Wynne stated she was conversant with the Rule and the Charge and confirmed she did admit the breach.
Mr Davidson had Stipendiary Steward Mrs Rebecca Haley, identify Miss Wynne (OAKSDEEL) racing mid field approaching the 450m. Mr Davidson pointed to Miss Wynne strike her horse 7 times prior to the 100m and thereafter, another 5 strikes.
Miss Wynne made no submissions.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Davidson stated Miss Wynne had breached this Rule twice on the same day at the Cup Meeting at Riccarton in November and contravened the Rule in the 4th race today. He said this is now her fourth breach within the reset period and the Guidelines indicate a 5+ day suspension as Penalty.
Mr Davidson said, in relation to a fine for breaches of the Whip Rule in Black Type races, Miss Wynne’s share of the stake was relatively minor and it might be considered not to be added to Miss Wynne’s penalty.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 5+ day suspension starting point for a fourth breach of this Rule with 2 additional strikes.
The Adjudicative Committee considers the status of the race an aggravating factor and uplift the 6-day starting point to a 7-day suspension.
CONCLUSION:
Class A Jockey Miss Samantha Wynne is suspended from the conclusion of racing on 14 May 2025, up to and including racing on 25 May 2025.
