Background:
Following the running of Race 1, the ‘Westend Bowling Club Maiden’, an Information was lodged alleging a breach of Rule 638(3)(g)(ii). Details are as follows:
‘in that he used his whip in consecutive strides in the home straight on JOEJOECCINI’.
Rule 638(3)(g)(ii) provides:
(g) A Rider must not
(ii) strike a horse with whip in consecutive strides at any stage of the race.
The Respondent confirmed to the Adjudicative Committee that he understood the Rule and admitted the breach.
Evidence:
Using available film, Stewards identified the incident. Just after the 100 metre mark, the Respondent is seen to strike his mount in consecutive strides. This is repeated on the post. The Respondent agreed with Steward count/interpretation.
Decision:
As the Respondent admitted the breach, the Adjudicative Committee found the breach proved.
Submissions for Penalty:
Stewards outlined the Respondent’s record. He received a warning under this Rule at the Otaki Maori Racing Club Meeting on 19 October 2024.
Reasons for Penalty:
Referencing the NZTR Penalty Guide, along with circumstances around the breach, a fine of $200 was deemed an appropriate penalty.
Conclusion:
Jockey Mr Harry Grace is fined a sum of $200.
