FACTS

Jockey Harry Grace admitted a breach of the Whip Rule in that he struck his mount in consecutive strides inside the final 100 metres on two occasions.

The films of the incident were shown, the strikes counted and commented on and confirmed.

DECISION

As the breach was admitted, the charge was found proved and submissions called on penalty.

SUBMISSIONS ON PENALTY

Stipendiary Steward K Coppins stated that Harry Grace has been charged on two previous occasions under this Rule. Both charges resulted in fines, one of $200 and the other $300. He referred the Adjudicative Committee to the Penalty Guidelines, and added that Harry Grace’s mount did go on to win the race and this should be considered when setting the penalty.

Jockey H Grace stated that riding in two countries with different Whip Rules has caused problems for him. With help, he believes he is on top of the problem.

REASONS FOR THE PENALTY

It was pointed out to Harry Grace, that any further breaches of this Rule could result in a suspension. He did go on to win the race and an uplift of penalty was appropriate. A fine of $600 was imposed and equated to a fraction more than 50% of his winning Rider’s fee.

CONCLUSION

Harry Grace was fined $600.
