SUMMARY OF FACTS:
Following Race 9 Mr W Pinn was charged with failing to ride his mount “BROTHER MAX” out to the end of the race, when there was a reasonable chance of finishing in a higher placing.
EVIDENCE:
Mr Pinn said that he understood the Rule and the Charge.
Mr Oatham showed the film replays and said that near the 100m Mr Pinn’s mount got a little tight. He said from thereon Mr Pinn made no attempt to ride forward and was beaten for 5th placing by a diminishing ½ length.
Mr Pinn did not comment when invited to do so.
REASON FOR DECISION:
Due to the charge being admitted together with the compelling film evidence, the charge was found proved.
SUBMISSION FOR PENALTY:
Mr Jones said that Mr Pinn had breached another section of the Rule 3 times in the last 12 months, but that this was his first breach under Section 636(1)(d). Mr Jones alluded to the Penalty Guide.
Mr Pinn did not comment.
Mr Harris said that Mr Pinn has had some problems but is working hard to get things right.
REASON FOR PENALTY:
The film evidence was very clear that Mr Pinn failed to ride out over the final 100m when there was a reasonable chance of finishing in a higher placing.
The Penalty Guide starting point for such a breach is a fine of $300.
Taking into account all matters in relation to penalty, it was considered that there was not any reason to depart from the starting point.
CONCLUSIONS:
Mr Pinn was fined $300.
